PROIEX Buyer Account Terms

These Buyer Account Terms supplement the PROIEX Platform Terms. They govern buyer registration, onboarding and ordinary account use. They do not govern the purchase of a particular property.
1. Buyer account
You must be an individual aged 18 or over, act for lawful purposes and provide your legal identity and current contact information. Unless we expressly approve another arrangement, a buyer account may be used only by the named individual.
Creating and keeping an ordinary buyer account currently has no account fee. Fees, cancellation rules, deadlines, payment obligations and remedies for a particular transaction are shown before you sign that transaction's separate QES Platform Agreement. They are not created by accepting these Buyer Account Terms.
2. Verification
You may need to verify your email, phone, identity, address and source or proof of income, and to provide updated information if a document expires or circumstances change. Depending on Platform configuration, Persona or Didit performs identity and proof-of-address checks.
Identity workflows can include an ID document, selfie, liveness check and face comparison. The provider-specific notice and any explicit biometric consent are separate from this agreement and must be shown before that processing starts. The Privacy Notice explains the information PROIEX receives and when copies of ID or address documents may be stored in a mortgage-document bundle or made available to an authorised notary.
Verification results may automatically place your application into passed, failed or review status and may temporarily gate Platform functions. You can ask support@proiex.com for human review of a result that affects your access. We may need additional evidence and cannot override a binding legal or provider limitation.
3. Property information and independent checks
Listings and property documents are supplied primarily by sellers and other transaction participants. PROIEX may review completeness and obvious consistency, but approval or a verification label is not a guarantee of ownership, absence of encumbrances, planning status, construction quality, value, seller solvency or fitness for your purpose.
The Albanian notary and any lawyer, surveyor, bank or other professional perform their own functions independently. You should review all documents and obtain independent legal, tax, technical and financial advice appropriate to a cross-border property purchase.
4. Starting a transaction
Selecting a property or starting a workflow does not transfer title or create a legal reservation. You will be shown a separate QES Platform Agreement at transaction step 1. Do not proceed unless you understand its property, fee, timing and cancellation provisions.
When that signed first step is completed, the Platform may apply the operational Platform Lock described in the Platform Terms. That lock affects Platform availability only. It does not guarantee that the seller will complete the sale, that financing will be approved or that the property can legally be transferred.
5. Mortgage workflow
Any calculator, estimated payment or illustrative mortgage amount is informational and is not an offer, recommendation or approval. A partner bank independently determines whether to accept an application and on what terms.
Where you ask to use a mortgage workflow, the Platform may collect identity, proof-of-address, proof-of-income, credit and property documents. The Platform must identify the receiving bank and the data to be sent before any outbound bank submission. Until an integration is actually enabled and disclosed, a workflow status must not be understood as confirmation that a package has been transmitted to a bank.
6. Power of attorney and PROIEX agent
A power of attorney is not granted through account registration. If a transaction requires one, its scope, duration, agent identity, permitted acts, revocation and legal effect will be set out in a separate transaction document and notarial process.
The fact that a PROIEX group entity employs an agent in Albania does not authorise that person to act for you until a valid power of attorney or other lawful authority has been completed.
7. Your responsibilities
You must:
- use your legal name and keep contact, residence and verification information current;
- review documents and status messages promptly;
- provide lawful, authentic and complete documents;
- protect account and signing credentials;
- disclose errors or suspected fraud promptly; and
- comply with each separately signed transaction, payment, notarial, banking or power-of-attorney document.
You must not treat a Platform status, calculator or support message as legal, tax, investment or credit advice.
8. Account withdrawal and closure
You may withdraw from or close the ordinary account service at any time without an account cancellation fee through [ACCOUNT CLOSURE / WITHDRAWAL URL] or support@proiex.com. We will acknowledge an online withdrawal request on a durable medium.
Closing the account does not cancel a QES Platform Agreement, property contract, payment instruction, mortgage application already delivered to a bank, power of attorney or notarial act. Use the cancellation process in the relevant separate document for those matters.
9. Priority and contact
For ordinary account use, these terms take priority over the Platform Terms on buyer-specific issues. A later signed transaction document takes priority for its transaction.
