PROIEX Notary Account Terms

These Notary Account Terms supplement the PROIEX Platform Terms. They govern a notary's professional account and Platform access. They do not replace notarial law, professional rules or a separate cooperation agreement.
1. Professional eligibility
You must be a notary, authorised employee of a notarial office, or other person expressly approved for the assigned role. You must provide accurate identity, office, jurisdiction, licence, authority, contact and bank-account information and keep it current.
Before professional functions are enabled, PROIEX may verify the notary or office against official records and require supporting documents. Account registration before the licence/profile is identified does not bind the professional office to transaction-specific instructions.
If a licence, appointment, authority or insurance expires, is restricted or becomes subject to investigation relevant to Platform work, you must tell PROIEX promptly and stop using functions you are no longer authorised to perform.
2. Independent professional role
The notary remains independent and is not directed by PROIEX in matters reserved to professional judgement or public authority. A Platform status, checklist, uploaded document or automated prompt does not determine legal validity, title, capacity, compliance, escrow release or the content of a notarial act.
The notary must perform all identity, authority, conflict, title, legality, escrow, reporting, recordkeeping and professional duties imposed by applicable law and rules. The Platform does not reduce those duties.
3. No current notary Platform fee
PROIEX currently charges no fee to a notary for creating or using a notary account or completing assigned Platform tasks.
This does not state that a notarial act, registry service, escrow service or other professional service is free. Any lawful notarial or statutory charge belongs to the relevant independent engagement and must be disclosed by the responsible professional or authority. PROIEX will not introduce a fee payable by notaries through an update to these terms without clear advance notice and fresh affirmative agreement.
4. Assigned transactions and workflow records
Use transaction access only for matters assigned to you or your office. Confirm appointments, request lawful corrections, upload final documents and update statuses accurately and promptly.
Marking a step complete confirms only the action and scope stated for that step. Do not mark a signature, payment, escrow event, legal reservation, collateral act or transfer complete unless you have verified the event under the applicable process and are authorised to record it.
5. Buyer verification and supporting documents
For an assigned transaction, the Platform may provide a provider verification report, full-size ID front/back, proof of address, power of attorney, property due-diligence documents and other supporting files. Availability depends on the buyer completing the relevant step and on provider/document status.
“Not available yet” means that the required buyer action, provider retrieval or authorisation has not completed. It is not evidence that a missing legal requirement has been waived.
You must:
- access only documents necessary for the assigned professional purpose;
- not share them with unauthorised staff or parties;
- verify authenticity and sufficiency independently where your duties require it;
- avoid downloading or retaining extra copies unless required for the official file;
- apply professional secrecy, secure storage and statutory retention; and
- report misdelivery, unauthorised access or suspected fraud immediately to security@proiex.com.
Provider reports and Platform verification status are supporting information, not a substitute for a notary's mandatory identification.
6. Property and transaction documents
Seller-uploaded or Platform-collected documents may be incomplete or superseded. The notary must obtain and verify authoritative records required for the act. PROIEX does not certify title or instruct the notary to disregard an encumbrance, conflict or legal defect.
The internal Platform Lock is not a legal reservation or registrable property right. Treat only the appropriate signed and legally valid instrument as a legal reservation, sale, mortgage security or other real-estate act.
7. Escrow and funds
PROIEX does not become custodian of client funds merely by displaying payment or escrow information. The notary or other identified provider remains responsible for any escrow account and disbursement under its legal mandate and the applicable written instructions.
Do not deduct or transfer the seller's 2% mediation fee unless a valid signed mediation agreement, invoice and lawful escrow/disbursement instruction authorise it. The intended timing is after execution of the final notarial sale contract and before release of net proceeds to the seller.
8. Account security and office users
Each user must use an individual account. Do not share passwords, signing credentials or verification documents. Apply least-privilege access within the office and remove access promptly when a staff member's role ends.
Notify security@proiex.com immediately about compromise, misdirected documents, suspicious instructions or an incorrect transaction assignment.
9. Suspension and professional records
PROIEX may restrict access where a licence or authority cannot be verified, a security or confidentiality risk exists, an authority requires action, or these terms are materially breached. Where legally and operationally possible, we will give reasons and an opportunity for review.
Closing or suspending the account does not alter the validity, custody or retention of an official notarial record and does not discharge professional duties.

Changes follow section 16 of the Platform Terms. A new notary-paid fee, material data-access expansion or material professional obligation requires clear advance notice and fresh acceptance or a separate cooperation agreement.
